When you submit a resource consent application to the Regional Council, several important decisions are made under the Resource Management Act 1991 (RMA):
Acceptance of the Application (Section 88 of the RMA)
The Council first decides whether to accept your application based on whether it contains sufficient information. To ensure your application is accepted, be sure to complete the relevant application forms for the activity and provide all required additional information. Even if accepted under Section 88, the Council may still request further details during the assessment process under Section 92 of the RMA.
Notification of the Application (Sections 95–95G of the RMA)
The Council will determine whether your resource consent application should be notified. If notified, others may submit their views. Public notification allows any person to lodge a submission, while limited notification restricts submissions to those identified as directly affected. Notification may lead to a hearing if submissions are received. Most applications are processed without notification.
Decision on Granting Consent (Section 104 of the RMA)
Finally, the Council will decide whether to grant the resource consent and, if granted, the specific conditions will be included in the consent.
